Khaiyal Terms of use

Eligibility criteria for registration

For use of Khaiyal Services, you must be at least eighteen years old. you have never been suspended or removed from the Khaiyal Services. Your account registration and usage of the Services fulfill with all applicable laws and regulations by accepting these Terms of use. For registration on Khaiyal you will be required to enter personal information while creating an account, including your cell number, email address, CNIC, profile information and other contact information. You attest to the accuracy of this information and your commitment to keep it updated at all times. You will also establish a password when you register. The secrecy of your account and password, as well as any activity carried out using your account, are entirely your responsibility. Sharing your account with others is strictly prohibited. You may only use the Services for your personal transactions unless you have a business arrangement that permits you to use the Services on behalf of another party.

Use of the Services; Restrictions

Use of services

We give you a non-exclusive, limited, revocable, personal, and non-transferable license to use the Services as long as you abide by these Terms of Use. As allowed by relevant law, you may also use the Services to act on behalf of your clients and give information to them if you are a real estate or mortgage professional operating in your professional capacity (“Pro Use”). You guarantee that you have acquired all required permissions and consents from your customer if you use the Services for Pro Use. You do not have a license to use, reproduce, distribute, display, or grant access to any portion of the Services on other websites or in any other location, unless otherwise indicated in these Terms of Use. Furthermore, transactions involving commercial real estate—including but not limited to properties in commercial zones and holiday rentals—may not be conducted through the Services.

Use of mobile

You must have a suitable mobile device in order to use any of the Khaiyal Services’ mobile application features (referred to as a “App”). It’s crucial to remember that compatibility can differ depending on hardware and software configurations, therefore we cannot guarantee that any app will run smoothly on your particular device. For example, you can experience problems downloading or using the most recent version of an app if your smartphone is running an outdated operating system. You acknowledge that these Terms of Use will be applicable to all updated versions of an Khaiyal app and agree to all automatic upgrades. Any open source software from third parties that is incorporated into an application is governed by the corresponding open source license and could be purchased directly from the developer. Your use of software licensed under an open source license from third parties is not governed by these Terms of Use.

Use of content

You may manually copy information from the Services for your personal use or Pro Use to read, store, print, fax, and/or email, subject to the limitations specified in these Terms of Use. However, the Khaiyal Local-Info Pages’ aggregate data (also known as “Aggregate Data”) may be utilized for non-personal objectives like real estate market research. As long as the Khaiyal group are credited as the source on each page where the Aggregate Data are shown, you are free to display and distribute derivative works of the Aggregate Data. This reference needs to say “Data Provided by Khaiyal Group.” Without prior written consent, the citation cannot incorporate the logos of any Khaiyal group or suggest any connection between you and the Khaiyal group other than citing them as the source of the data. Data from other Khaiyal group cannot be displayed without prior written consent.

Prohibited use

You are prohibited from reproducing, modifying, distributing, displaying, or otherwise providing access to, creating derivative works from, decompiling, disassembling, or reverse engineering any portion of the Services, except as explicitly permitted by the Product’s Terms applicable to that product’s Services.

You may not provide, post, or authorize a link to any of the Services (including but not limited to an agent profile page) from a third-party website that is not a real estate-related website owned or operated by a real estate or lending professional or institution.
You are prohibited from removing or modifying any copyright or other intellectual property notices that appear in the Services.
You must not use the Services in any manner that is unlawful or harmful to the khaiyal, its service providers, suppliers, affiliates, or any other user.
You must not use the Services in any way that discriminates against any individual or class of individuals protected under federal, state, or local laws, or in any way that has a discriminatory impact or promotes illegal, racist, or discriminatory activities or outcomes.
You are prohibited from posting, displaying, communicating, or otherwise making accessible to any third party on or through the Services (including, but not limited to, an agent profile page) a seller’s or listing agent’s offer of buyer agent compensation, including the amount, percentage, or even the fact that such compensation is offered, regardless of whether it is connected to any specific property.
You must not distribute or post spam, planted/fake/unwanted messages, chain letters, pyramid schemes, or similar communications while using the services.
You must not imitate another person, misrepresent your affiliation with any person or entity, or make any false representations to any third party. You are prohibited from reproducing, publicly displaying, or otherwise making accessible on or through any other website, application, or service any reviews, ratings, or profile information about real estate, lending, or other professionals, as well as any underlying images or information about real estate listings, or other data or content available through the Services, except as explicitly permitted by us for a specific portion of the Services.
You must not upload invalid data, viruses, or other malicious software agents to the Services.
You are not allowed to post, reproduce, publicly display, or otherwise make accessible any content that we, in our sole judgment and discretion, consider illegal, offensive, or objectionable, including but not limited to content that harasses, discriminates, demeans, threatens, or disparages any individual or class of individuals.
You must not interfere with or compromise the system integrity or security of the Services, or attempt to bypass any measures we use to prevent or restrict access to the Services.
Automated queries, including screen and database scraping, spiders, robots, crawlers, bypassing “captcha” or similar precautions, or any other automated activities aimed at obtaining information from the Services, are prohibited.
You are not permitted to use any of the Khaiyal group’ trademarks as part of your screen name or email address on the Services.
Accessing or using any of the Services to develop competitive products or services is prohibited.
You must not attempt to, or encourage any third party to, engage in any of the above activities.

License Grant

Certain parts of our Services may allow users to upload or provide images, photos, videos, data, text, listings, and other content (“User Materials”) to the Khaiyal group. Unless otherwise specified in your Product’s Terms, by uploading or submitting User Materials, you grant us final, endless, royalty-free worldwide license to:

(i) use, copy, distribute, transmit, publicly display, perform, reproduce, edit, modify, create derivative works from incorporate into other works and translate your User Materials in connection with the Services or through any other media

(ii) sublicense these rights as allowed by applicable law. We will not compensate you for your User Materials or for exercising any rights related to them as outlined above. We reserve the right to remove or modify your User Materials at any time. You are solely responsible for all User Materials submitted through your account(s) on the Services or made available through the Services.

For all User Materials, you represent and warrant that you are the creator and owner of those materials, or that you possess the necessary licenses, rights, consents, and permissions (including all required under applicable privacy and intellectual property laws) to allow the Khaiyal group and other users to access and use your User Materials as needed to exercise the licenses granted by you under these Terms of Use. We will not use client contact information uploaded by agents into the Khaiyal Agent Hub portal for any purpose, unless that information is provided to us directly by the client.

Disclaimer

We are not obligated to edit or control your User Materials or those of any other user and will not be responsible or liable for any User Materials. However, we reserve the right to screen, remove, edit or block any user content on the Services, including User Materials, at any time and without prior notice, if we determine, in our sole discretion, that it violates these Terms of Use. You acknowledge that while using the Services, you may encounter User Materials from other users that could be inaccurate, offensive, indecent or objectionable. You agree to waive, and do waive, any legal or equitable rights or remedies you may have against us regarding User Materials. We expressly disclaim any and all liability related to User Materials. If we receive a notification from a user or content owner that User Materials allegedly violate these Terms of Use, we may investigate the claim and at our sole discretion, decide whether to remove those User Materials. We reserve the right to do so at any time and without notice.

Third Party/Linked Services/Sent information

The Services may include links to third-party products, services, and websites, as well as materials provided by third parties. They may also feature functionality that allows for the distribution of your User Materials or personal information (collectively, your “User Information”) to third parties not under our control (each referred to as a “Third-Party Provider”). Third-Party Providers are fully responsible for their services. You are accountable for how you use and submit User Information to any third party and any dealings or transactions with those parties related to the Services are solely between you and them.

Your use of third-party sites, services, or products may be governed by their own terms of use, privacy policies and other agreements which you are responsible for adhering to. We do not endorse or take responsibility for such products, services, websites, or materials, nor for a Third-Party Provider’s handling of your User Information. By using a tool that enables the transfer of User Information, you agree that we may share the relevant User Information or other data with third parties that are not under our control.

If you submit a contact form or express interest in contacting a Third-Party Provider, you may receive telemarketing calls from that provider using the contact information you provided. Third-Party Providers may retain your contact information and any other details received while processing your request. We are not responsible for any damages or costs arising from your interactions with these third parties.

Intellectual Property

The Services are owned and operated by the Khaiyal Group. The Khaiyal Companies or their third-party licensors own the user interfaces, design, information, data, code, goods, software, graphics and any other components of the Services which are safeguarded by intellectual property laws and other legal frameworks. The Khaiyal Group retain all rights to the Materials and Services not specifically granted in these Terms of Use, and you are not permitted to use them unless specifically allowed by these Terms of Use. The underlying photos, goods or descriptions of real estate listings offered through the Services are not protected by copyright, nor do we give any rights to them. The copyright owner must grant permission for any use of these pictures and descriptions, and any use must abide with the law.

Feedback

You give us the unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use any feedback you choose to provide about the Services, including any of the Khaiyal Group Materials (“Feedback”), however you see fit, including to develop new products and services or to improve the Services.

Deactivation/Deletion /Changes to Agreement

You can deactivate your account at any time by choosing “deactivate account” in your account settings, unless otherwise noted in the terms of any product. You can “delete your data” by submitting a request at portal of Khaiyal Group to have your account and all related data deleted. You will still be liable for any unpaid costs associated with your use of the Services that were accrued before termination, even if you decide to deactivate or delete your account.

Your authorization to use the Services will automatically expire if you break any of these Terms of Use. Furthermore, at any time and for any reason, with or without prior notice, we have the right to deactivate, suspend or terminate your access to your account and the Services. Additionally, we have the right to abruptly change, stop or terminate the Services or any portion of them.

Any modifications to the Services, as well as any suspension or termination of your usage or access to the Services, will not be our responsibility. We retain the right, at our sole discretion, to modify these Terms of Use at any time, and we will try our best to notify you of any important modifications. After such amendments go into effect, your continuing use of the Services will be interpreted as your acceptance of the updated Terms of Use. Additionally, you give up any claim to explicit notification of these changes. Reviewing these Terms of Use on a regular basis is your obligation.

Indemnification

You consent to indemnify, defend and hold harmless the Khaiyal Group, our affiliates and our individual directors, officers, employees and agents from any and all claims and demands made by any third party because of or resulting from: (I) your use of the Services; (II) your violation of these Terms of Use; (III) any legal or third-party rights violations; (IV) any dispute or issue between you and any third party; (V) any User Materials you upload to, or otherwise make available through, the Services; (VI) your willful misconduct; and (VII) any other party’s use of the Services using your account and password. Any issue that would normally be subject to your indemnity may be subject to the exclusive defense and control of the Khaiyal Group at their own expense; in such a scenario, you consent to assist the Khaiyal Group in defending such claim.

Choice of Law; Disputes

The laws of the State of Pakistan, except its conflict of laws provisions, govern these Terms of Use. For any disputes, claims or actions arising from or related to the Services or otherwise under these Terms of Use, you consent to the exclusive and exclusive jurisdiction. The Khaiyal Group cannot guarantee that the services are suitable or accessible in other places.

Consent to Communications

You agree to receive specific electronic messages from us as detailed in the Privacy Policy by using the Services. To find out more, please read our Privacy Policy. You acknowledge that any electronic notifications, agreements, disclosures, surveys, or other correspondence we provide you will meet all legal communication requirements, including the need that they be in writing. You can get in touch with the Khaiyal Group or other parties, such real estate brokers and Third-Party Providers, by using the web forms, links, or phone numbers that the Services may offer. A third-party service known as a “Communications Service” may be used to route communications sent using these techniques. Calls may be monitored or recorded for customer service, training, or quality control reasons. If a call is being recorded or monitored, you will be informed at the start of the call.

You provide permission for the Communications Service or the Khaiyal Group to record and monitor you in this way. In order for us and the real estate professional to obtain specific contact information, we also employ the Communications Service to monitor phone conversations and text messages between you and the professionals. We and the Communications Service will receive and retain information about your call or text message in real time as part of this process. This information will include your phone number, the date and time of the call or text message, and the text message’s content. You give us and the Communications Service permission to use these practices. The Privacy Policy governs the information.
